how do you get caught using torrent sites?
if i use a torrent site like limewire to get free music and transfer it into my ipod then how will i get caught if i dont sell it? is there a way they can catch u out of the blue?
Limewire is not a tracker; it’s a bad client, but not a tracker.
The process goes like this:
If the copyright holder has reason to suspect that their intellectual property has been duplicated without their consent, then they will hire copyright infringement watchdog agencies such as BayTSP or MediaSentry to collect IP addresses that have been observed in the swarm.
The way any individual gets caught is by connecting to a monitoring client. These are other BitTorrent clients in the swarm that *look* exactly like regular clients and they do, in fact, download and/or seed the file just like regular clients do. The difference is that they are run by anti-piracy groups such as BayTSP and MediaSentry and they collect the lists of IP addresses that the client connects to.
If your ISP is contacted, they will be asked to hand over the records of the IP block to which the observed IP belongs within a certain time frame specified by the copyright holder. These records will contain the names of the customers and their corresponding IP block(s). In most countries, the ISP is under no legal obligation to relinquish this information. If law enforcement is contacted, a warrant can be issued. The ISP may try to resist the issuance of a warrant. If it escalates to this point, the ISP will probably comply eventually to avoid further legal fees. Once the copyright holder has the names of the customers who illegally duplicated their intellectual property, they can choose to sue those individuals for damages. Those individuals can either pay a settlement or hire a lawyer and fight the case.
